Sloppy lawyers beware: using AI to draft a factum can land you in serious regulatory and legal trouble. In Ko v. Li, 2025 ONSC 2766, Myers J had reasonable grounds to believe one party’s factum had “hallucinated” fake cases using generative AI. Because lawyers have a duty not to mislead the court, he required the lawyer to show cause why they should not be found in contempt.
These tools are now ubiquitous. It seems plain to me that we need to be addressing this issue in law schools, bar materials, and CPD trainings. Although I can’t imagine how any lawyer who rely in submissions on cases they’ve never read.
